You understand accepting our terms of service, you hereby, acknowledge and agree the ultrasound services and imaging provided at MEET YOUR BABY 3D 4D Ultrasound , are not medical procedures and are not offered as a medical treatment or diagnosis in any manner. Further, the ultrasound services and imaging are not for the purposes of determining or to be used in future to determine the health status of the fetus(es) and you the mother or the well being of the mother , or fetus(es) at this time or during the pregnancy or at the birth of the fetus(es).

You acknowledge and agree that the ultrasound services and images are for entertainment purposes only and are not to be used at any time for the purposes of any medical diagnosis, treatment or care of the fetus(es) or mother. Further you solemnly declare that you are of legal age in Canada to get our services and do not require any consent from parents and guardians.

You understand you are electing to purchase MEET YOUR BABY 3D 4D Ultrasound services , for keepsake, non-medical purposes only. The individual providing services at MEET YOUR BABY 3D 4D Ultrasound is certified by American registry of diagnostic medical sonographers(ARDMS) , but not a medical professional and is not providing medical care. You agree that you have no right to recourse against MEET YOUR BABY 3D 4D Ultrasound in any medical malpractice, professional negligence, or any medical related claim arising out of or in any way related to your pregnancy or the birth of your child. This includes any claim for error in sex determination.

You declare that you the client while obtaining ultrasound services, are already under the care of a qualified physician regarding the pregnancy at the time of the ultrasound services and imaging. You agree and acknowledge that under no conditions will MEET YOUR BABY 3D 4D Ultrasound,its owners, its staff, agents, or employees, be held liable or accountable for any consequences of any known or future unknown medical condition of the mother and the fetus(es) or for failure to diagnose, treat or inform to undersigned of any said known or unknown medical conditions, risks or problems regarding the undersigned mother and fetus(es).

By choosing to utilize any of our services, you are automatically accepting our terms of service. You hereby release, acquit, hold harmless and forever discharge MEET YOUR BABY 3D 4D ULTRASOUND, its owners , staff, agents and employees, from any and all matters of foreseen or unforeseen claims, demands, damages, actions, or causes of actions by you individually and/or on the behalf of the fetus(es), resulting from any ultrasound imaging performed at MEET YOUR BABY 3D 4D ULTRASOUND.

By taking any action and/or scheduling on our website, you hereby waive, release, acquit and forever discharge MEET YOUR BABY 3D 4D Ultrasound from any and all claims, expenses, demands, costs, causes of action, and other actions and liabilities, of any nature whatsoever, whether known or unknown, whether in law or equity, that yourself or your baby may have , arising out of or in any way related to your visit to MEET YOUR BABY 3D 4D Ultrasound . You agree that you shall have no right whatsoever to file any lawsuit or institute any other action or legal proceedings of any type arising out of or in any way related to your visit to MEET YOUR BABY 3D 4D Ultrasound . MEET YOUR BABY 3D 4D Ultrasound as defined in this disclosure shall include MEET YOUR BABY 3D 4D Ultrasound , its owners, officers, agents, employees, independent contractors, attorneys, and affiliated related entities.

You understand and acknowledge that this Waiver and Release is a binding legal document that affects your legal rights and remedies. You further understand and acknowledge that this Waiver and Release binds not only yourself, but also your spouse, children, heirs, representatives, distributes, guardians, and assigns.

You agree and acknowledge that no guarantee can be made or has been made at the time of the imaging as to the picture or video quality and/or content of the imaging due to circumstances beyond the control of MEET YOUR BABY 3D 4D Ultrasound, its staff, agents and employees, including, but not limited to the position of the fetus(es), position of the placenta or position of the internal organs of the mother.

As we provide a service, not a product, refunds will not be granted in any circumstances listed above, or for circumstances out of our control. MEET YOUR BABY 3D 4D Ultrasound , its employees, agents, or staff attempts to retain backup files of ultrasound images and/or video for you. How ever we are not responsible for damages to digital storage devices once your session with us ends.

You understand that MEET YOUR BABY 3D 4D Ultrasound owns the rights to any photos, videos or images produced during an ultrasound session. You can of course, request images not to be used in marketing before hand in writing. You understand that if sufficient notice is not given, images may already have been used online. We would of course take measures to remove them upon that request. You hereby authorize MEET YOUR BABY 3D 4D ULTRASOUND to use any photos, videos or images produced during an ultrasound session for any manner whatsoever, including but not limited to, marketing materials, social media, and other promotional materials. I acknowledge that , I have carefully read and understand this Waiver of Liability and Photo Release in its entirety and hereby acknowledge and consent to its contents.
